The Bankruptcy Appellate Panel in the Ninth Circuit: A Historical Perspective
Our first panel will focus on the history of the Bankruptcy Appellate Panel (“BAP”) here in the Ninth Circuit, looking at why (some) other Circuits don’t have one, and why ours is so successful. The program will also look at the decision to take an appeal to the District Court vs. the BAP, with considerations for practitioners. We will discuss other fun facts such as how bankruptcy judges are selected for the BAP and when bankruptcy judges sit on the BAP by designation.

Bigfoot of the Bankruptcy World: The Mythical Bankruptcy Jury Trial
Bankruptcy Judges can and do conduct jury trials, albeit infrequently and only when certain stars are properly aligned. This program will include a discussion of the statutes and rules applicable to conducting jury trials in bankruptcy courts and will highlight some of the joys, obstacles and war stories associated with conducting a jury trial before a bankruptcy judge.
